Scotland Food & Drink is the industry leadership organisation tasked with driving responsible growth for the sector and building Scotland’s global reputation. We are a collaborative partnership of the key industry organisations and public sector agencies working in the sector in Scotland and we are a membership organisation.

Any personal data provided by you to us will be held and processed in accordance with the data protection principles set out in the General Data Protection Regulations for the purposes of meeting the legitimate interests of Scotland Food & Drink (SF&D) and adhering to the rights of the individual.

The information we hold on you as an individual:

We hold personally identifiable information if you are an employee of a business who is a current, previous or prospect member of Scotland Food & Drink,  if you have attended an event hosted by Scotland Food & Drink or if you are an Industry Contact of Scotland Food & Drink.

The information we hold on you is:

  • Your full name
  • Your workplace
  • Your job title
  • Business contact details – work email and work phone number

Scotland Food and Drink recognises that while this is business related information that it is still considered personally identifiable under the legislation and so treats it in this way.

The information we hold on you as a Soletrader:

The information we hold is:

  • Your business name
  • Your business address
  • Your business contact details – email and phone number
  • Key information about your business such
  • Specific company information (limited to size, structure, accreditation, sub-sector)   
  • High level financial information (limited turnover bands) 
  • Market information (routes to market, target markets, market channels)   
  • HIE relationship status / SFD relationship/membership 
  • Business support requirements 

The information we hold on you as an individual within your business is:

  • Your full name
  • Your title within your business

Scotland Food and Drink recognises that while this is business related information that it is still considered personally identifiable under the legislation and so treats it in this way.

Why we require your information

We collect personally identifiable information, as stated above, when your business joins as a member, when you register with us to attend our events or when you use our services. We ask you for this work-related personal data, as stated above, only when it is needed to provide your business with goods or services you have enquired about or asked us to provide or to respond to your request for information. You do not need to provide us with personal data simply to browse our site.

SF&D uses this information in the following ways:

  • To fulfil your request for information about certain products or services
  • To communicate with you about your membership
  • To provide you with industry news
  • To provide joined up services with other service delivery partners
  • To customise the content you see on our website
  • To contact you about our events or services
  • To communicate with you generally

Event specific - when you register to attend one of our events we will use your personal information, as stated above, to:

  • process your registration
  • provide you with information about the event
  • follow up with you after the event for feedback

What justification is there for holding this information

Where you are a Member of Scotland Food & Drink (including TBAS and SDA) and or when you sign up to an event or service provided by us (including our newsletter) we hold this information under the lawful basis for processing of:

(b) Contract: the processing is necessary for a contract you have with the individual, or because they have asked you to take specific steps before entering into a contract.

Where you are considered a prospect member or an industry contact of Scotland Food & Drink we keep minimal information on your business under the lawful basis for processing:

(f) Legitimate interests: the processing is necessary for your legitimate interests or the legitimate interests of a third party, unless there is a good reason to protect the individual’s personal data which overrides those legitimate interests. (This cannot apply if you are a public authority processing data to perform your official tasks.)

Where we store your personal information

We store your information on our secure Customer Relationship Manager system (Apptivo).

We store your information within Xero for the purposes of invoicing your business (where applicable).

We take measures to ensure you data is secure and have taken steps to ensure our cyber security complies with GDPR regulations.

Do we share your information without your consent?

Scotland Food & Drink will only pass your business information on to a third party where they are subcontracted to us to deliver part of a service you have signed up to (this includes event and programme attendance) and / or where Scotland Food & Drink are providing a joined up service with other service delivery partners  and where it is deemed that your business will benefit from this service.

Those contracted do not store your business information and only use it for the purposes of fulfilling the service and Data Sharing Agreements are set up to reflect this. More information on this will be supplied at the point of booking on to any of our events and programmes so you have full transparency of how your information is being used and why.

Service Delivery Partners only use your business information for the purposes of the joined up service being provided and Data Sharing Agreements are in place.

Your rights around the information we hold

Right to Access

If at any time you would like to know what information we hold on you please email us at info@foodanddrink.scot and in line with GDPR legislation we will provide you this information for free within 72 hours.

Right to Correction

If you believe that we hold inaccurate information on you and you would like us to amend this then please email us at info@foodanddrink.scot and we will make any appropriate rectifications in line with GDPR legislation immediately.

Right to Erase

You have the right to request that we delete any contact information on you. If you would like to request this, then please email info@foodanddrink.scot

Please note: Scotland Food & Drink will retain certain information where we believe this is a legitimate business interest.

Right to no further contact

If you do not want to have contact from us again then please email us at info@foodanddrink.scot and we will ensure that you are not contacted again in line with best practice under the GDPR legislation.

Privacy by Design

Scotland Food & Drink adopts a privacy by design approach to all of its process and procedural development to ensure that the privacy of individuals data is considered from the outset.

What to do if you no longer wish us to contact you

If you no longer wish to receive information from Scotland Food & Drink, simply let us know by filling in this form.

By requesting this, we won’t contact you about business opportunities, food and drink industry news or events and any other service we can provide.

How long do we retain your personal data for

Scotland Food & Drink will only retain your personal data for as long as necessary to fulfil the purposes it is collected for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

The appropriate retention period for personal data takes into consideration the nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which it is being processed and whether those purposes can be achieved through other means, and the applicable legal requirements.
